ADDENDUM TO
RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2008-00260
INDEX CODE: 110.00
XXXXXXX COUNSEL: NONE
HEARING DESIRED: NO
______________________________________________________________
APPLICANT REQUESTS THAT:
His under other than honorable conditions (UOTHC) discharge be
upgraded.
________________________________________________________________
STATEMENT OF FACTS:
On 15 May 2008, the Board considered and denied a similar
appeal. For an accounting of the facts surrounding the
applicants previous request and the rationale of the Board's
earlier decision, see the Record of Proceedings at Exhibit H.
In his appeal for reconsideration, applicant provides a
statement in which he discusses the events as they transpired
during his period of service. In support of his appeal, he
provided character reference statements and certificates of
training.
The applicants complete submission, with attachments, is at
Exhibit I.
________________________________________________________________
THE BOARD CONCLUDES THAT:
After reconsideration of the applicants appeal and the
additional documentation provided, we believe it is likely he
has overcome the behavioral traits which led to the discharge
action and he has led a stable and productive life since the
separation. We recognize the adverse impact of the discharge he
received; and, while it may have been appropriate at the time,
we believe it would be an injustice for him to continue to
suffer its effects. Accordingly, we find that corrective action
is appropriate on the basis of clemency and recommend the
records be corrected as indicated below.
________________________________________________________________
_
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that on
31 March 1995, he was discharged with service characterized as
general (under honorable conditions).
________________________________________________________________
_

The other is Section 8964, which is a separate section dealing with circumstances not applicable to his situation. In this respect, we note that Section 8963, Title 10 USC, allows members to retire in the highest grade in which they served on active duty satisfactorily as determined by the Secretary of the Air Force. Further, SAFPC determined the applicant served satisfactorily on active duty in the grade of MSgt and should be retired in that grade.
